Terms of Service

These Terms of Service ("Terms") govern your use of the LaunchListing platform, website, and services (collectively, the "Service") operated by LaunchListing ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

To use LaunchListing, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old and legally able to enter into contracts.

2. Subscription Plans & Billing

LaunchListing offers paid subscription plans billed monthly or annually. By subscribing, you authorize us to charge your payment method on a recurring basis. Plan details, including pricing and active listing limits, are described on our Pricing page.

  • Free Trial: New accounts receive a 7-day free trial with full access. No credit card is required to start. If you do not select a paid plan before the trial ends, your account will be paused.
  • Upgrades & Downgrades: You may change your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of your current billing period.
  • Cancellation: You may cancel your subscription at any time. Access continues through the end of your current billing period. We do not offer partial refunds for unused time.

3. Acceptable Use

You agree to use the Service only for lawful purposes related to real estate marketing and reporting. You may not:

  • Use the Service to distribute spam, malware, or misleading content
  • Attempt to access other users' accounts or data
  • Reverse-engineer, copy, or redistribute any part of the Service
  • Use the Service in any way that violates applicable laws or regulations
  • Resell or sublicense access to the Service without our written consent

4. Your Content & Data

You retain ownership of all content you upload or create using the Service, including listing data, reports, images, and branding assets ("Your Content"). By using the Service, you grant us a limited license to host, display, and process Your Content solely to operate and improve the Service.

We do not sell your data. If you cancel your account, you may export Your Content for up to 30 days after cancellation. After that period, we may delete it.

5. Third-Party Integrations

The Service may connect to third-party platforms including social media networks, real estate portals, and CRM systems. Your use of those integrations is subject to the respective third party's terms and policies. We are not responsible for the accuracy, availability, or reliability of third-party data.

6. Intellectual Property

The Service, including its design, code, features, and branding, is owned by LaunchListing and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology beyond what is necessary to use the Service.

7. Limitation of Liability

To the maximum extent permitted by law, LaunchListing is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that third-party data (including portal statistics and social media metrics) will be perfectly accurate at all times.

9. Indemnification

You agree to indemnify and hold harmless LaunchListing from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

10. Modifications to the Service or Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms or if required by law. You may terminate your account at any time by canceling your subscription and contacting us. Sections 4, 6, 7, 8, and 9 survive termination.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Sacramento County, California.
